NEW DELHI, September 10: The Supreme Court has dismissed Abu Salem’s plea seeking premature release from his life sentence in the 1993 Mumbai serial blasts case, upholding the Bombay High Court’s earlier rejection of his request.
Salem Cites Portugal Extradition Assurance
Salem argued that India had given Portugal a sovereign assurance that his imprisonment would not exceed 25 years when he was extradited to India in 2005.
He sought to have his undertrial custody and earned remission counted toward that limit.
Supreme Court Rejects Early Release
A Bench of Justices Vikram Nath and Sandeep Mehta rejected Salem’s appeal and upheld the Bombay High Court’s April 2026 decision.
The High Court had held that Salem’s plea was premature and that the 25-year extradition commitment had not yet reached the stage for release.
Centre Must Honour 25-Year Commitment
The Supreme Court had ruled in 2022 that the Union government remains bound by its assurance to Portugal and must act to release Salem when the applicable 25-year period is completed.
Thursday’s ruling, however, gives Salem no immediate relief from imprisonment.
