The ra** case involving Kolkata’s female trainee doctor has angered the whole country. In many states, the situation is such that both common people’s demonstrations and those of doctors still go on. This affects also the available hospital services. Also heard once more today concurrently at the Supreme Court was the topic. A status report the CBI filed in to the court indicates compromise of the crime scene. One has sought to conceal the truth in order to save the accused.
There may have been important incident related evidence lost.
Regarding this, the Chief Justice told West Bengal government attorney Kapil Sibal that the record in the police diary shows that the crime scene was kept maintained following the post-mortem, so there is a possibility of major evidence related to the occurrence being lost being destroyed. As he attempted to elucidate, Justice Pardiwala said that whatever justification Sibal is offering is unacceptable. This notebook exposes also unnatural death at 11.30 p.m.
Having worked over thirty years, I have hardly seen such negligence.
“When was the Panchnama done? Can you explain to us why this record shows such variation?” ?” Hon’ble Supreme Court judge asked Joint Director of CBI during the hearing. Sibal sought to intervene on this, but the court stopped him and declared, “Your police’s established legal procedure departs fundamentally from the Criminal Procedure Code. Having worked thirty years, I had not seen such negligence.
The episode has one quite disturbing aspect:
At the same time, the Chief Justice asked Sibal whether one aspect of this occurrence truly disturbs her. Given that the cops recorded the death time as 10.10 am, why was the crime scene locked at 11.30 pm? What were the cops doing up till then? Bring a responsible police officer who can respond to all of our questions the Supreme Court instructed the next day. During the hearing the Solicitor General said, “A person connected to the hospital has submitted an application and said that irregularities were being done in this hospital for a long period. Also protested to the government of 2023; nothing resulted.”
