Following the Supreme Court’s ruling on the creamy layer in the SC-ST quota, the national government made a major declaration. Prime Minister Narendra Modi’s Union Cabinet meeting included discussion of this problem. The Cabinet unanimously resolved in this meeting that the NDA government is committed to upholding all terms of the Constitution. Union Minister Ashwini Vaishnaw made a statement. Dr. Babasaheb Ambedkar’s Constitution does not contain a clause regarding the creamy layer for the SC-ST quota. Consequently, reserves for SCs and STs will follow the Constitution exactly.

Recently, the Supreme Court instructed the Centre to consider sub-categorizing the SC/SST reservation. It had also advised the government to investigate the possibility of creamy layers on this reserve. Many members of the ruling party voiced their discontent following this choice. Union Minister Chirag Paswan was among those who disagreed. Since then, the central government has acted quite carefully in this regard.

Chief Justice DY Chandrachud led a Constitution bench of the Supreme Court that examined whether the Backward Castes Act, 2006, and the Punjab Scheduled Castes reservation quota could grant preference to Mazhabi Sikhs and Valmikis in government employment. The Supreme Court then declared that state governments could grant reserves by creating a sub-category within the SC-ST quota. The SC/ST organizations had complained to the government shortly following the court’s ruling.

The Prime Minister assured us all that the central government will not implement the Supreme Court’s decision.
