The dispute over temple-mosque in the country is not stopping. One after the other, every day some mosque is being claimed to be a temple. Actually, after Sambhal in Uttar Pradesh, now it has been claimed that there is a temple in Atala Masjid built in the 14th century in Jaunpur district. Claiming that there is a temple in Atala Masjid, Swaraj Vahini Association has filed a petition in Jaunpur court. In this petition, the right to worship there has been demanded. According to the information received, a petition has been filed in Allahabad High Court against this matter by the Atala Masjid administration. However, it is up to the High Court to decide whether the case can be heard in the court of Jaunpur or not.
Atala Masjid was earlier Atala Devi Temple
Let us tell you that the next hearing in this case is to be held on 9 December. According to the information received, in the petition filed by the association and Santosh Kumar Mishra, it has been claimed that Atala Masjid was earlier Atala Devi Temple. Therefore, the followers of Sanatan Dharma have the right to worship in it. They have demanded from the court to take possession of the property of the case as well as to stop the defendants and other non-Hindus from entering the concerned property. Let us tell you that in August this year, the court of Jaunpur issued an order approving the case, the judge said that “this case is admissible in his court.” On May 29, the court ordered to register the case and start the hearing.
The trial court should have dismissed the complaint on these grounds
Meanwhile, in the petition filed by Waqf Atala Masjid Jaunpur in the High Court, it has been said that “There is a flaw in the petition of the petitioner Swaraj Vahini Association. Because the plaintiff is a society registered under the Society Registration Act, not a judicial person.” It further states that “the trial court should have dismissed the complaint on these grounds. The local court erred in directing registration of the suit.” Waqf Atala Masjid also argues that “the property in question has been registered as a mosque and has been in continuous use since its construction in 1398. Not only this, the Muslim community offers regular prayers including Friday prayers. Further, it was also argued that even the Waqf Board was not made a party to the suit.”
