The Bombay High Court has observed that Akshay Shinde, an accused in the Badlapur lynching case, was killed in a police encounter. The father of the deceased had filed a petition in the High Court, calling the encounter ‘fake’ and demanding an investigation into the whole matter. During the hearing of the same petition on Wednesday, Justice Chavan of the Bombay High Court posed several stinging questions to the government counsel. “How did the accused Akshay Shinde get shot in the head? The police know where to shoot. In response, the public prosecutor told the high court that the officer’s pistol was unlocked.”I don’t believe that,” the judge said. There are some problems with this. A common man cannot fire a pistol because it requires force.”
Four policemen could not catch the accused
“When there were four policemen at the back, how is it possible that they could not control a lone unarmed person, that too in the back of the vehicle? There were two policemen in front of him. Even four policemen could not catch the accused. All CCTV footage should be preserved
Significantly, the court ordered the police to preserve all the CCTV footage from the time accused Akshay Shinde was brought out of jail to the time he was declared dead at Shivaji Hospital.”The incident needs to be investigated thoroughly,” the court said. The court also directed the state government to submit the sealed report of the forensic lab to the court. The court also directed the Maharashtra Police to file a cross-FIR in the case. The next date of hearing in the case is October 3.
