A 65-year-old doctor had filed a PIL in the Supreme Court seeking that the word ‘Hindutva’ be replaced with the Indian Constitution. The word Hindutva is damaging the secular fabric of the country. But the court rejected outright this new attempt to link ‘Hindutva’ with fundamentalism.
Abuse of legal process
The petition was filed by Dr. SN Kundra in the Supreme Court. “The word Hindutva leaves a lot of scope for radicals of a particular religion to convert our secular Constitution into a religious Constitution. Some religious fanatics are trying to promote cultural hegemony in the garb of Hindutva inside the country. At the same time, efforts are also being made to make Hindutva a symbol of nationalism, which is causing a lot of damage to our secular fabric.
A particular religion is being promoted using the word ‘Hindutva.” Hence, the use of this word should be avoided. Dismissing the plea, a bench headed by Chief Justice D.Y. Chandrachud said, “We cannot entertain such petitions. Terming it an abuse of the process of law, the court also expressed displeasure over the petitioner.
Petitions have already been filed in the Supreme Court against the use of the word ‘Hindutva’
Earlier, two petitions were filed in the Supreme Court against the use of the word “Hindutva.” The two petitions were filed in 1994 and 1995. In the December 1995 case, the court had ruled that the exact meaning of the words Hindu, ‘Hindutva’, and ‘Hinduism’ cannot be explained, nor is their meaning restricted to any narrow limit. These words cannot be construed to denote communalism towards other religious faiths. A review petition was filed in 2016, but the Supreme Court refused to hear it.
